Warranty Information
DRAT Construction stands behind its craftsmanship. Unless a signed project agreement states otherwise, DRAT Construction provides the following limited one-year warranty on work performed by DRAT Construction.
One-Year Workmanship Warranty
For one year after substantial completion of DRAT Construction’s work, DRAT Construction warrants that its workmanship will be performed in a workmanlike manner consistent with the agreed project scope. “Substantial completion” means the date the work is sufficiently complete for its intended use, as reflected by the completion record or final invoice.
This warranty covers a defect caused by the way DRAT Construction performed or installed the work. It is a warranty of DRAT Construction’s labor and craftsmanship only.
Materials Are Not Warranted by DRAT Construction
DRAT Construction does not warrant any lumber, decking, fasteners, fixtures, finishes, coatings, hardware, appliances, or other products or materials used on a project. This exclusion applies whether the materials were selected, purchased, supplied, or paid for by the customer, by DRAT Construction, or by another person.
Material quality, characteristics, performance, and defects are the responsibility of the manufacturer or supplier and are subject only to any warranty they provide. DRAT Construction does not adopt, extend, or replace a manufacturer, retailer, supplier, or other third party’s warranty.
Decking, Treated Lumber, and Cedartone Products
Wood and manufactured building products can change after installation. Shrinkage, expansion, contraction, checking, splitting, cracking, cupping, warping, twisting, fading, discoloration, surface variation, weathering, sap, knots, and similar product behavior are material conditions and are not defects in DRAT Construction’s workmanship.
This applies specifically to treated lumber and Cedartone deck boards. If deck boards shrink or develop gaps because of the material’s characteristics or performance, DRAT Construction is not responsible for the material and is not required to purchase or provide a replacement deck surface.
If DRAT Construction agrees to resecure or rescrew boards, replace a deck top, or perform other corrective labor related to an excluded material condition, the customer must purchase or otherwise provide all replacement materials unless a signed written agreement expressly states otherwise.
What the Warranty Does Not Cover
In addition to materials and product behavior, this warranty does not cover:
- Normal wear and tear, routine maintenance, cosmetic aging, or expected weathering.
- Damage or changes caused by moisture, drainage, leaks, freeze-thaw cycles, extreme weather, fire, flood, wind, acts of nature, pests, mold, or environmental conditions.
- Movement, settlement, heaving, or failure of soil, foundations, structures, or existing construction not caused by DRAT Construction’s workmanship.
- Abuse, misuse, overloading, neglect, failure to maintain, or use inconsistent with the intended purpose.
- Work, repairs, alterations, or materials supplied or performed by the owner or any third party.
- Designs, plans, specifications, or instructions supplied by the owner, designer, engineer, manufacturer, or another third party.
- Incidental or consequential costs such as loss of use, relocation, storage, lost income, or damage unrelated to the covered workmanship defect, to the extent permitted by law.
How to Make a Warranty Claim
The customer must notify DRAT Construction in writing during the one-year warranty period and within a reasonable time after discovering the claimed defect. The notice should describe the issue, identify the project, include available photographs, and provide reasonable access for inspection.
Except for steps reasonably necessary to prevent immediate damage or address a safety emergency, the customer should not have the claimed work altered or repaired by another person before DRAT Construction has a reasonable opportunity to inspect it.
Warranty Remedy
If DRAT Construction determines that a timely claim is covered, DRAT Construction will, at its option, repair or reperform the defective workmanship without charging for its corrective labor. This is the customer’s remedy under this workmanship warranty.
DRAT Construction does not pay for or provide replacement materials when the need for replacement results from an excluded material defect, material characteristic, normal product behavior, or a manufacturer or supplier issue. The customer is responsible for the cost and availability of those materials, including related delivery, disposal, or third-party charges.
Courtesy Work Does Not Expand the Warranty
DRAT Construction may voluntarily inspect, adjust, resecure, rescrew, or assist with an issue that is not covered. Courtesy service does not mean that the issue was caused by DRAT Construction’s workmanship, does not create a material warranty, and does not extend or restart the one-year warranty period.
Project Agreements and Applicable Law
A signed project agreement or project-specific written warranty controls if it provides different terms. This warranty gives the customer specific contractual rights, and the customer may also have rights under applicable law that cannot be waived or limited. No statement on this page excludes any right or remedy that cannot lawfully be excluded.
